Cancellations

Orders that are canceled before shipment are subject to a 5% restocking fee (order edit requests resulting in equal or greater cart total are not subject to a restocking fee). Credit card processing fees are not refunded to us, even if the order is canceled. As a result, we must charge a restocking fee to cover these unrecoverable costs.

Refunds

To assist in your evaluation of our ModalWorks products, we offer a 30-day return period (timed by the recipient's delivery date). You may return your product in new/unused condition within 30 days of the original shipment date for a refund. 

• A 20% restocking fee applies to all returns, and purchasers are responsible for all return shipping charges. 
• Original shipping charges at the time of purchase are not refunded.
• Modalworks is not responsible for any expenses incurred by the returning party when evaluating purchased goods. The purchaser is responsible for all return shipping charges. 
• It is the responsibility of the returning party to pack and ensure the items are returned to Modalworks properly. Lost or damaged packages that are sent back to Modalworks for return will not be refunded.  
• If there is a manufacturing defect with the product, Modalworks will work with you to rectify the defect.  

Modalworks is not responsible for any expenses incurred by the returning party when evaluating purchased goods.

1. ECU Tunes

There is NO WARRANTY on ECU Tunes. Please understand that mechanical issues, improper performance part combinations, not following directions, and "Butt Dyno" reactions are not our responsibility. The ECU tune service must be used within 30 days of purchase. After 30 days, the tune purchase cannot be cancelled or refunded. Visit the manufacturer’s site for warranty details. 

1. General Products

This warranty covers defects in materials and workmanship of your ModalWorks product for 1 year from the date of purchase for the original purchaser.

This warranty does not cover any of the following:

• Any shipping costs for returning the product to Modalworks or dispatching a replacement unit
• Any costs incurred for the downtime of the vehicle, rental vehicle, or towing costs
• Any labor costs to diagnose the issue or replace any of the products
• Any normal wear and tear, such as scratching, yellowing/dulling, or wear items like brakes, calipers, and pads. 
• Damage due to (a) transportation, (b) storage, (c) improper use, (d) failure to follow the Product instructions or to perform any preventive maintenance, (e) modifications, (f) unauthorized repair, (g) normal wear and tear, (h) any type of racing or competition, (i) any off-road use, or (j) external causes such as accidents, abuse, or other actions or events beyond our reasonable control (e.g., acts of God and natural disasters).

We will repair any Product that proves to be defective in materials or workmanship. If repair is not possible, we will either replace your Product with a new Product of similar composition and price or refund the full purchase price of your Product, at our sole discretion. There is no charge for inspection.

This warranty becomes void if the product is modified, improperly installed, or damaged prior to or during installation. It does not cover damages caused by misuse, neglect, abuse, acts of nature, exposure to extreme temperatures, or normal wear and tear such as nicks, scratches, abrasions, and natural aging. Modalworks reserves the right to change product design, specifications, and materials without prior notice.

The repair or replacement of a product under this warranty is subject to the availability of current products within the Modalworks Inc. line at the time of the warranty claim. If a warranted product is no longer available, Modalworks Inc. may replace it with a similar product of equal function.

This warranty represents the sole remedy available to the warranty holder. Modalworks Inc shall not be liable for any consequential, special, or indirect damages arising from the use of its products. THIS LIMITED WARRANTY REPLACES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. To the extent permitted by law, any implied warranties are limited to the duration of this warranty. Claims must be initiated through Modalworks Inc by emailing support@modalwork.com. Proof of ownership and the date of purchase may be required, and the product or component may need to be returned to Modalworks Inc before a replacement is provided.

OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
