ModalWorks, Inc. ("ModalWorks," "we," "us") operates modalwork.com. This policy explains what personal information we collect, how we use and share it, and your choices.

1. Information We Collect

Order information: name, billing and shipping address, email, phone number, vehicle information, and order history. Payment card details are processed by our payment providers. We do not store full card numbers.
Device and usage information: IP address, browser and device type, time zone, pages viewed, referring sites, and how you interact with our site, collected through cookies, log files, pixels, and similar technologies.
Communications: emails, chat messages, contact-form submissions, phone notes, photos you send us, and reviews.
Transaction-security data: address and card-verification results, fraud-screening results, and records of your acceptance of our Terms of Service, including date, time, and IP address.

2. How We Use Information

To process, fulfill, ship, and support your orders, returns, and warranty claims
To communicate with you about orders and, with your permission, marketing
To detect, prevent, and investigate fraud, unauthorized transactions, and abuse
To respond to chargebacks and payment disputes, including sharing order, delivery, communication, and acceptance records with payment processors and card issuers
To comply with legal, tax, and customs obligations and to enforce our Terms
To improve our website, products, and advertising

3. How We Share Information

We do not sell your personal information for money. We share it with service providers that help us run our business, including Shopify (store platform), payment processors, carriers (UPS, USPS, DHL), Guide Shipping Protection, accounting and email providers, and analytics and advertising partners such as Google and Meta. We also share information with card issuers and payment processors in connection with disputes; with fraud-prevention services; with customs authorities for international shipments; with law enforcement or courts when required by law or to protect our rights; and with a successor in a business sale or merger.

4. Targeted Advertising and Cookies

We and our advertising partners use cookies and similar technologies to show you ads that may interest you. Under some state laws this may count as "sharing" or "targeted advertising." You can opt out through your browser cookie settings, at optout.aboutads.info, at Google Analytics opt-out, or by enabling Global Privacy Control in your browser. We do not change our practices in response to "Do Not Track" signals.

5. Data Retention

We keep order, transaction, and communication records for as long as needed to fulfill orders, honor warranties, resolve disputes and chargebacks, and meet legal, tax, and accounting requirements, generally at least 7 years.

6. Your Privacy Rights

Depending on where you live (including California, Texas, Virginia, Colorado, Connecticut, and other U.S. states, and the EU/UK), you may have the right to access, correct, delete, or obtain a copy of your personal information, and to opt out of targeted advertising or the sale or sharing of personal information. To make a request, email support@modalwork.com. We will verify your identity before responding and will not discriminate against you for exercising your rights. Some information we must keep (for example, transaction and dispute records) may be exempt from deletion. If we deny your request, you may appeal by replying to our decision.

For EU/UK residents, we process information to perform our contract with you, to comply with law, and for our legitimate interests, including fraud prevention. Your information may be transferred to and stored in the United States.

7. Security

We use reasonable safeguards to protect your information, but no method of transmission or storage is completely secure.

8. Children

Our site is not intended for anyone under 18, and we do not knowingly collect information from children.

9. Changes

We may update this policy by posting a revised version on this page with a new "Last updated" date.
